Can you travel outside Canada after applying for a work permit extension?

When you apply to extend your Canadian Work Permit, you are granted the freedom, to leave Canada and come back. However, when re-entering, you need to take care of a few things.

Like, in some cases, you may need to return under the Canada Visitor Visa, instead of a temporary resident.

This means that you will not be allowed to continue working in Canada - if you travel outside Canada.

Re-entry as a visitor

You, as a work permit extension applicant, may be permitted to re-enter Canada as a visitor. Meaning, you cannot work upon your return until Immigration, Refugees and Citizenship Canada (IRCC) makes a decision on your extension application. At this time, you may also be asked to prove to the IRCC officer that you have enough money to support yourself - throughout your stay in Canada.

Request to apply for a new work permit

As an extension applicant, you may also be asked to apply for a brand-new work permit at the port-of-entry, - upon your return to Canada. Take note that under this scenario, you can immediately start working (continue working) in Canada - if you apply at the port of entry when you return, or if you need to wait for the new permit to be processed.

Re-entry as a worker

In some cases, the IRCC officer will determine that you were granted your work permit extension while outside of Canada. In this scenario, you may be allowed to return to Canada as a worker.

Re-entry requirements as a work permit holder

While you are allowed to leave and re-enter Canada without obligations, as a work permit holder you must also meet certain re-entry requirements to be allowed back into the country. For instance, in addition to the work permit requirement, you must also have either a Canada Visitor Visa (a Temporary Resident Visa) - or an Electronic Travel Authorization (eTA).

Still, despite all this, IRCC states that “Having an eTA or a visa, along with your work permit, doesn’t guarantee that we will let you back into Canada.”

Visitor Visas and eTA

The re-entry requirements for temporary residents in Canada vary depending, - on your situation, as these requirements for re-entry are different for residents of visa-exempt countries

According to IRCC, in addition to the work permit, if you fall under visa-exempt countries, you must have a valid passport and an Electronic Travel Authorization (eTA). An eTA is only required if you’re planning to go through the Canada Immigration process and enter Canada by air. As a temporary resident, “you don’t need an eTA if you’re arriving by car, bus, train or boat (including cruise ship).”

Residents of visa-required countries

As a resident of a visa-required country, you will still require a valid visa or a work permit to return to Canada - for work. In the case your visitor visa has expired or was only, for instance, valid for a single entry to Canada -you must re-apply for a visitor visa. In addition, as a resident of a visa-required country, you can use a valid visitor visa to travel to Canada until it expires. A visitor visa will let you travel to Canada by plane, car, bus, train or boat.

How to extend your stay in Canada in 2024?

There are many reasons immigrants may need to extend their stay in Canada. If you have undergone the Canada Immigration process as a Visitor or Temporary Resident, and wish to stay longer - you may be eligible to apply for an extension as a visitor.

Extending your stay as a visitor

If you’ve arrived in Canada as a visitor, you would have at least one of these documents:

  • An Electronic Visa Authorization (eTA), or

  • Canada Visitor Visa (also known as a Temporary Resident Visa)

If you need to extend your stay in Canada, you would need to apply for a Visitor Record.

You must apply for a Canada Visitor Record before your current status expires. A majority of Visitor Visas are issued for 6 months. Your status expires 6 months from your date of entry to Canada.

What is a Visitor Record?

A Canada Visitor Record is not exactly a visa. It is a government-issued document that gives you the right to remain in Canada legally. A Visitor Record comes with an expiration date - at which point you must leave the country, or submit another extension to remain in the country.

A Visitor Record does not guarantee a re-entry to Canada.

Extending your stay as a temporary resident

If you are in Canada as a Visitor, Temporary Worker, or Student, you may be eligible to renew your status. To be eligible, you must:

  • Submit your application before the original status expires.

  • Continue to meet the initial requirements of your stay.

  • Abide by all the conditions of your status in Canada.

  • Meet the requirements of the currently applying for an extension through.

How to apply for an extension?

To apply for an extension, you must complete an application package and provide your personal information and supporting documents to Immigration, Refugees and Citizenship Canada (IRCC). You can apply through IRCC’s online portal.

If you are immigrating to Canada with your family, they must submit separate applications for an extension.

Generally, you would need to follow these steps:

  • Gather the necessary documents

  • Pay the application processing fee

  • Complete the application form with accurate information and details

  • Sign and date your forms

  • Submit your application to the IRCC.

The process of applying for an extension can sometimes seem like a daunting task - especially for first-timers. Seek guidance from Best Canada immigration consultants in Delhi if you’re having trouble.

How long does the process take?

The current process time to apply for a Visitor Record in Canada is 2 months. Processing times may vary depending on the nature of your case and the application inventory.

What happens next?

If your application is successful, you will receive an immigration document that grants you the status – along with a new expiration date. In case your application is refused/rejected - you can only stay in Canada until the expiration of your current temporary resident status.

You must be physically present in Canada to apply for an extension - even when your application for an extension is being processed. If you leave the country, you will be required to submit a new Canada Immigration application to re-enter Canada.

Good Luck!

Tourist Visa for Canada from India open or not?

Indians who wish to visit Canada can apply for a Canada tourist visa. However, they must hold a passport with validity for up to 6 months. Tourist visas for Canada remain open all year round and the processing of non-essential visitor visas was only suspended during the COVID outbreak. The Immigration, Refugees, and Citizenship Canada (IRCC) also suspended some Electronic Travel Authorization (eTA) applications as well.

Applying for a Canada tourist visa is mandatory for Indian nationals as there is no facility for a Visa on Arrival. This visa allows you to explore the best of this country - happening life in cities, visit shimmering lakes, enjoy outdoor activities, meet warm-hearted people, and revel in culture and food.

Types of Canada Tourist Visas

The Canadian government grants two types of tourist visas to visit the country for holidays and meet friends/family.

  • Single Entry Visas

  • Multiple Entry Visas

As the name suggests, a Single Entry Visa for Canada allows you to enter the country only one time. You are eligible for this visa type if you are eligible for fee-exemption and your purposes of visit are limited, you might be taking part in a special event, or there are approved country-specific procedures. And once you exit Canada, you need a new visa to enter again. But you don't need a new visa if you are visiting the USA and then returning to Canada.

Whereas, a Multiple Entry Visa lets you travel to Canada for 6 months as many times as you like. The visa will be valid for up to 10 years or a month before your passport expires. However, the exact period will be decided by the visa officer issuing it.

One of the most popular tourist destinations in Canada. A visitor to Canada will undoubtedly have a spellbinding experience, from experiencing the natural sceneries to taking a helicopter or balloon excursion over the Niagara Falls and Toronto. But with the level of security and restrictions that this industrialized country has upheld, travelling across Canada as a tourist has never been a piece of cake. Except for countries that are free from requiring a visa to enter Canada, Indian citizens must obtain a tourist visa before travelling there. But getting a tourist visa to Canada has never been that difficult. This visa guide will provide you with all the assistance you need to successfully complete the online application for a tourist visa to Canada as well as the offline application process.

Visitors entering Canada for tourism are eligible for a special type of visa that is issued by the Canadian government. However, there are two types for the Canada visa, as follows:

The sub-category of Temporary Resident visas includes the Canada Tourist visa. The Border Patrol Officers (BPO) are in charge of approving or rejecting this visa before it is issued to a tourist to Canada who does not match the requirements specified by the Canadian government. The Canadian tourist visa is typically selected for travel, vacations, or visiting friends, family, or other relations. If a national of one of the few nations free from requiring a visa is travelling to Canada by air, they may need an ETA (Electronic Travel Authorization).
